Information about the Right of Withdrawal
The here shown clarification comes from the Legislative Decree n° 21 of 2014, in force as of 26th March 2014, enforcing the Directive 2011/83/UE on Consumer Rights.
Customers have the right of withdrawal to back out of a distance contract, without penalties and without giving reason, within a 14 days period starting from the delivery day.
The right of withdrawal has to be stated by sending a written communication to info@atempore.it within the stipulated period.
Customers can not exercise their right of withdrawal on orders regarding "custom-made or clearly customized products" (art. 59 of the above mentioned Decree) and "non- prefabricated goods made on the basis of an individual choice of or decision by the consumer" (art. 2 of the above mentioned Decree): due to the highly customizable nature of our collections and to the manufacturing processes of our suppliers, which are mainly made upon commission, the majority of the products in our catalogue belongs to this category, therefore the right of withdrawal cannot be exercised; for more information please contact our Customer Care before the purchase or before the putting into production of the order.
Furthermore customers can not exercise their right of withdrawal on sealed products which cannot be returned due to hygienic and health-related reasons (for example, mattresses, pillows, bed linens) and in case the package has been opened after the delivery .
The right of withdrawal can not be exerted on not-customizable products in the following cases: contracts which are not included inside the directive on Consumer Rights (products purchased with a VAT number for professional aims); contracts negotiated and stipulated at ATEMPORE of MORA PROGETTI s.a.s. headquarters; products included in a contract negotiated at ATEMPORE headquarters and then finalized by passing an online order at a later stage.
Customers have to return the product at their own expenses to ATEMPORE within 14 days starting from the day of withdrawal and they are responsible of the diminished value coming from manipulating the products in a different way from the one needed to state the nature, the characteristics and the functioning of the product itself.
If the right of withdrawal is exerted according to the following directives, ATEMPORE will refund the money paid with the exception of any other extra charges the customer requested. By exercising the right of withdrawal on a single product which, for some reasons, was part of a promotional Free Standard Shipping inside a bigger supply, this promotion will not be applied on the product anymore; in this case shipping costs will be charged to the buyer as per shipping fares and therefore detracted from the refund due.
The refund will occur within 14 days starting from the day of withdrawal, if the customer complied with his or her obligation of returning the product within 14 days from the withdrawal; in case of payment by Bank Transfer the refund will occur in the first working day after ATEMPORE of MORA PROGETTI s.a.s. received the bank coordinates from the customer.
Informativa sul Diritto di Recesso
Quanto illustrato in questa pagina è tratto dal Decreto Legislativo n° 21 del 2014, in vigore dal 26 marzo 2014, ed emesso in attuazione della Direttiva 2011/83/UE sui diritti dei Consumatori. Il consumatore ha il diritto di recedere da qualunque contratto a distanza, senza alcuna penalità e senza specificarne il motivo, entro il termine di 14 giorni decorrente dal giorno della consegna al consumatore. Il diritto di recesso si esercita con l'invio di una comunicazione scritta ad info@atempore.it entro il termine previsto.
Il consumatore non può esercitare il diritto di recesso per "beni confezionati su misura o chiaramente personalizzati" (art. 59 suddetto decreto) e per "per beni non prefabbricati prodotti in base a una scelta o decisione individuale del consumatore" (art. 2 suddetta direttiva): per l'elevata personalizzazione che caratterizza le nostre collezioni, e per i processi produttivi prevalentemente su commessa dei nostri fornitori, il diritto di recesso non è applicabile alla stragrande maggioranza dei prodotti del nostro catalogo, per maggiori informazioni al riguardo contattare il Servizio Clienti prima dell'acquisto o comunque prima della messa in produzione.
Il diritto di recesso non può essere altresì esercitato su beni sigillati che non si prestano ad essere restituiti per motivi igienici o connessi alla protezione della salute e sono stati aperti dopo la consegna (e.g. materassi, guanciali, biancheria,...). Il diritto di recesso non può essere infine esercitato anche sui beni "non personalizzati" nei seguenti casi: contratti non rientranti nella normativa sui Consumatori (beni acquistati con partita Iva per fini professionali); contratti negoziati e conclusi presso la sede ATEMPORE di MORA PROGETTI s.a.s.; contratti negoziati presso la sede di ATEMPORE e conclusi mediante l'immissione dell'ordine online "a distanza".
Il consumatore è tenuto a restituire il bene a proprie spese ad ATEMPORE entro 14 giorni dall'esercizio del diritto di recesso ed è responsabile della diminuzione del valore risultante da una manipolazione diversa da quella necessaria per stabilire la natura, le caratteristiche e il funzionamento del bene stesso. Se il diritto di recesso è esercitato dal consumatore conformemente alle disposizioni qui indicate, ATEMPORE rimborserà quanto versato ad eccezione dei costi supplementari che il Cliente ha richiesto. Esercitando il diritto di recesso su un singolo prodotto il cui valore ha consentito l'attivazione della promozione Spedizione Standard Gratuita all'interno di una fornitura più ampia, la promozione non sarà più applicabile; in questo caso le spese di spedizione dell'ordine verranno addebitate al consumatore come da tariffa e quindi detratte dal rimborso dovuto (da € 36,00 ad € 86,00 al metro cubo secondo la regione di spedizione).
Il rimborso avviene entro 14 giorni dall'esercizio del diritto di recesso se il consumatore ha ottemperato al proprio obbligo di restituire il bene entro 14 giorni dall'esercizio del proprio diritto; in caso di pagamento con bonifico bancario il rimborso avviene comunque nel giorno lavorativo successivo al momento in cui ATEMPORE di MORA PROGETTI s.a.s. viene a conoscenza delle coordinate bancarie dell'acquirente.
